8. Intellectual Property, Content & License

All intellectual property rights in the Services (including software, algorithms, models, logos, trademarks) are and will remain the exclusive property of Luckytatto.ai.

8.2 User Content

You retain ownership of your User Content. By submitting it, you grant Luckytatto.ai a non-exclusive, worldwide, royalty-free, perpetual license to process and use it to provide and improve the Services. We will not use your User Content for advertising or marketing without your explicit consent.

8.3 Generated Designs

Ownership by Paid Users: If you have an active paid subscription or have purchased credits, you own all rights, title, and interest in your Generated Designs. Luckytatto.ai hereby assigns to you any rights it may hold in such Generated Designs.
Personal License for Free Users: Free-tier users receive a limited, non-exclusive license for personal, non-commercial use of Generated Designs.
Commercial Use: Any commercial use (reselling, merchandising, using in business promotion, etc.) requires a paid subscription or license.
Disclaimer of Uniqueness: You acknowledge that the Services may generate identical or similar designs for multiple users. We do not guarantee the uniqueness of any Generated Designs.
Disclaimer of Third-Party Rights: Because AI outputs are probabilistic, Luckytatto.ai does not guarantee that Generated Designs are free from third-party copyright, trademark, or intellectual property claims. You are solely responsible for ensuring your intended use is lawful.

9. Subscriptions, Payments & Refunds

Payments: Certain features require a paid subscription or credits. You agree to provide accurate and valid payment details.
Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
Price Changes: We reserve the right to change pricing with reasonable prior notice.
Non-Refundable: All fees are non-refundable to the fullest extent permitted by law.
EU Withdrawal Waiver: If you are located in the EU, you acknowledge that by purchasing digital services (subscriptions/credits), performance begins immediately and you waive your statutory right of withdrawal.

10. Termination & Suspension

We may suspend or terminate your account for violation of these Terms, misuse of the Services, or for compliance/legal reasons.
You may terminate your account at any time.
Upon termination, rights to Generated Designs you created during your active paid term remain valid per Section 8.3.

11. Disclaimer of Warranties

We make no guarantees regarding availability, accuracy, or reliability of Generated Designs.
Use of tattoo designs on your body is at your own risk. We strongly advise consulting a professional tattoo artist and a licensed medical professional. We accept no liability for artistic, medical, or personal outcomes.

12. Limitation of Liability

To the fullest extent permitted by law:

Luckytatto.ai and its affiliates shall not be liable for any indirect, incidental, consequential, or special damages, including lost profits or data.
Our total aggregate liability for any claim shall not exceed the total amount paid by you to Luckytatto.ai in the 12 months prior to the event giving rise to the claim.
We are not liable for tattoo-related medical issues, infections, or complications, nor for the duplication of Generated Designs across users.

13. Indemnification

You agree to defend, indemnify, and hold harmless Luckytatto.ai and its affiliates from claims, damages, losses, or expenses arising out of:

Your misuse of the Services;
Your violation of these Terms;
Your infringement of third-party rights.

14. Governing Law & Dispute Resolution
